Privacy Policy

How Kapital Juan Insurance & Surety Agency collects, protects, and uses the information you share with us — including your rights under the Philippine Data Privacy Act.

1. Information We Collect

We collect information you directly submit through our website forms and communication channels. Collection is always limited to what is necessary to prepare, process, and support your insurance request.

  • Full name, email address, mobile number, and postal or service address submitted on quote or contact forms.
  • Vehicle details (make, model, year, plate, MV file, CTPL / comprehensive coverage history) for motor vehicle requests.
  • Property, location, construction, and occupancy details for fire / property insurance submissions.
  • Cargo type, route, conveyance, and declared value for marine cargo and inland transit requests.
  • Service-specific data for LTFRB franchise, bonds, and surety assistance requests.

We do not require and do not intentionally collect sensitive personal information such as health records, government-issued ID numbers, or financial account details unless strictly required for underwriting.

2. How We Use Information

All information submitted to us is used solely in connection with the brokerage and placement of insurance products, and for the legitimate operational purposes described below.

  • Generate and deliver premium estimates, quotations, and proposal documents.
  • Coordinate with our accredited carrier underwriting teams for risk review, pricing, and policy issuance.
  • Contact you by email, SMS, or phone to clarify details, request supporting documents, or deliver updates on your submission.
  • Process endorsements, renewals, claims referrals, and LTFRB or regulatory filings you have requested.
  • Maintain internal records and audit trails for compliance and quality assurance.
  • Send essential service notices, renewal reminders, and operational alerts (never marketing unless you have separately opted in).

3. Sharing of Information

As an insurance broker, we share a limited portion of your submitted data only with the parties necessary to complete your request. We do not sell, rent, or trade personal information to any third party.

  • Accredited insurance carrier partners and their underwriting teams, for assessment, quotation, and policy issuance.
  • Authorized Kapital Juan staff, agents, and appointed processors who require access to perform their duties.
  • Regulatory bodies (Insurance Commission, LTFRB, LTO, etc.) only to the extent required for filings, approvals, or compliance with law.
  • Professional advisers (auditors, legal counsel) bound by confidentiality obligations, for governance purposes.

All disclosures to carriers are made under non-disclosure and data-processing terms consistent with the Philippine Data Privacy Act of 2012 (R.A. 10173).

4. Data Retention

We retain information only for as long as necessary to fulfil the purposes for which it was collected, to meet our legal and regulatory obligations, and to resolve disputes.

  • Active quotation and policy records are retained for the duration of the policy relationship plus the minimum period required by the Insurance Code and Data Privacy Act.
  • Quote submissions that did not proceed to policy are generally retained for up to twelve (12) months for follow-up, audit, and anti-fraud purposes.
  • Records related to claims, disputes, or regulatory filings are retained for the duration of the applicable statute of limitations plus one (1) year.
  • Contact inquiries and non-transactional correspondence are retained for up to twenty-four (24) months.

Once the retention period expires, records are securely anonymized, deleted, or destroyed in line with our internal records management policy.

5. Security

We maintain reasonable and appropriate administrative, technical, and organizational safeguards designed to protect submitted information against unauthorized access, use, alteration, or disclosure.

  • Encrypted transport of form submissions via TLS / HTTPS.
  • Access-controlled internal storage with role-based permissions and authenticated staff access only.
  • Physical and electronic safeguards at our offices and for digital records.
  • Regular review and updating of controls, and documented procedures for incident response.

Note, however, that no method of electronic transmission or storage is completely secure; we cannot guarantee absolute security, and submissions are made at your own risk.

6. Your Choices Under the Data Privacy Act

Under R.A. 10173, you have specific rights regarding the personal information we hold about you. You may exercise these rights at any time by contacting our Data Privacy representative.

  • Right of access — request a copy of the personal information we hold about you.
  • Right to rectification — request correction of inaccurate, outdated, or incomplete data.
  • Right to erasure — request deletion of your data, subject to any legal or contractual retention obligations.
  • Right to object — opt out of processing for direct marketing or other non-essential purposes.
  • Right to withdraw consent — for processing that is based solely on consent; withdrawal does not affect prior lawful processing.
  • Right to data portability — request transfer of your data in a machine-readable format where technically feasible.
  • Right to file a complaint with the National Privacy Commission (NPC) if you believe your rights have been violated.

7. Updates to This Policy

We may amend this Privacy Policy from time to time to reflect changes in our practices, applicable law, regulatory guidance, or the scope of our services.

  • Material changes will be posted on this page with a revised “Effective” date at the top of the document.
  • Where a change materially impacts your rights or your relationship with us, we will also make reasonable efforts to notify you by email (to the address associated with your most recent submission) for a reasonable period.
  • Your continued submission of forms and use of our services after an update becomes effective constitutes acceptance of the revised policy.

8. Cookies and Local Storage

This site uses a minimal set of browser-based storage to preserve in-progress form state and basic preferences. We do not deploy cross-site tracking, advertising cookies, or third-party analytics beacons.

  • Session-only in-memory state to preserve partially completed quotation forms between tab changes.
  • LocalStorage entries tied to your in-progress quote or contact draft, cleared automatically on successful submission or after 7 days of inactivity.
  • Essential security tokens and server-managed session identifiers required for form submission integrity.

You can clear storage at any time through your browser settings; doing so may reset any in-progress form drafts you have not submitted.

Privacy requests are typically acknowledged within 48 hours and completed within 30 calendar days, subject to verification.
